On June 15th, 200l Chem Lawn sprayed my shrubs and trees with a herbicide. The spray killed my rose and azalea bushes immediately. My lilacs, weeping cherries, and dogwoods have not fully recovered. I have had three employees out to my home to assess the damage. With the assessment comes promises of replacing the roses, replanting trees, pruning. All to take place in the spring. I have had three azalea bushes replaced. The trees were suppose to be pruned in November. I have heard nothing from them since Sept. 24th. At one point they closed out my account and it wasn't until I called them did they let me know this. I have written several letters to the Manager in Puyallup, Jim Hanson and the President,Don Carnes, in Memphis, Tennessee. At the beginning of 200l, I had paid for a years ser! vice. In the letter to Jim Hanson, I asked for a refund of the remaining money, I received my refund check after 6 weeks, however it had this stamped on the back of the refund check; "upon acceptance of this payment payee does hereby release the Tru-Green Company and its employees, affiliates and subsidiaries and receives this payment as full and final settlement of any and all claims, and causes of action arising out of any direct or indirect damage, loss, or bodily injury....as a result of services provided by the TruGreen Company'". I wrote another letter asking Jim Hanson to put in writing that cashing the check would not close out my account for further work on my shrubs and bushes. I have not received any letters to date. Their lack of communication is astounding. I am writing to you because over 300 homes were sprayed that day and I would assume there were others in the Winterwood/Remmington divisions. I would like two things: I would be willing to put an artic! le in the homeowners newsletter and 2)please add them to the list of companies not to recommend to Winterwood Homeowners.
